Terms of Service

These terms apply when you buy a package or hire me, Ana Dias, a freelance web designer (trabalhadora independente) based in Portugal (“I”, “me”), to design and build a website. By placing an order or starting a project, you agree to them. If anything here is unclear, ask me through the contact page before you buy. You can find my business details on the legal notice page.
The services
I design and build websites. The main options are a Landing Page, a Full Website, and custom projects priced together. You can see what each includes on the services page. Custom work is scoped and agreed separately before it starts.
Quotes and payment
- The Landing Page and Full Website are paid in full up front through Stripe.
- Custom projects are scoped separately, and we agree the price and any payment schedule before work begins.
- Prices are shown in the currency listed at checkout.
Taxes
I am based in Portugal. Prices shown are exclusive of VAT or other taxes unless stated. Whether VAT applies depends on where you are and whether you are a business or a consumer: for most clients outside the EU, Portuguese VAT does not apply; EU business clients account for VAT under the reverse-charge mechanism. Any tax that does apply will be shown before you pay. You are responsible for any local taxes or duties in your own country.
Your right to cancel (EU consumers)
If you are a consumer in the EU, you normally have fourteen days to withdraw from a distance contract. Because the websites I build are made to your specifications and the work begins as soon as you order, by placing your order you ask me to start within that fourteen-day period and you agree that you lose the right to withdraw once the work has begun and is being performed. This does not affect your statutory rights if the work is faulty.
Refunds and cancellation
Before work starts, you can cancel and I will refund what you paid, minus any work already done at your request. Once work has begun, fixed packages are non-refundable, as explained above. For custom projects, cancellation terms are set out when we scope the work. The cancellation summary also appears at checkout before you pay.
Scope, content, and revisions
Each package covers the scope described on the services page. Work beyond that scope can be added and quoted separately. You are responsible for providing the content and assets I need, such as text, images, logos, and access, in a timely way. If you do not have these, tell me and we will figure out the best approach together.
Timelines
Any timeline I give is a good-faith estimate, not a guarantee. Real delivery depends on how quickly we exchange feedback, content, and approvals. I will keep you updated if anything affects the schedule.
Ownership and portfolio
Once a project is paid for in full, the final website and the custom work created for it are yours. Third-party parts, such as fonts, plugins, or stock assets, stay under their own licences. Unless we agree otherwise, I may show the finished work and describe my role in it in my portfolio and marketing.
Liability
I put real care into every build, but the site and services are provided without warranties beyond those required by law. To the extent the law allows, my liability for any claim connected to the work is limited to the amount you paid for it. I am not responsible for losses caused by third-party services, hosting, or events outside my reasonable control. Nothing in these terms limits any rights you have that cannot be limited by law, including your statutory rights as a consumer.
Ending a project
Either of us can end a project if the other seriously breaks these terms and does not put it right within a reasonable time, for example if invoices go unpaid or I cannot get the content or feedback I need to continue. If a project ends early, you pay for the work done up to that point, and the refund and ownership rules above apply.
Governing law and disputes
These terms are governed by Portuguese law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you can bring proceedings in your local courts. If we cannot resolve a dispute directly, EU consumers can use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. In Portugal, consumer disputes can also be referred to an alternative dispute resolution body such as CNIACC (Centro Nacional de Informação e Arbitragem de Conflitos de Consumo).
Changes to these terms
I may update these terms from time to time. The version that applies to your project is the one in place when you place your order. The “Last updated” date at the top shows the current version.
